Finder’s Fee Terms and Conditions
These finder’s fee Terms and Conditions shall govern the relationship between a Participant (‘you’ ‘your’ ‘participant’) and Lincolnshire Co-operative Limited (‘we’ ‘us’ ‘our’ ‘Lincolnshire Co-op’), regarding our location suggestion campaign.
Please read them carefully, as they affect your rights and obligations in relation to your participation in the campaign.
By participating in the campaign, you accept to be bound by these terms and conditions.
General
- Eligibility:
- The location suggestion campaign is open to all individuals aged 18 and above.
- Employees of Lincolnshire Co-op are eligible to participate, except those directly associated with the project.
- Submission Process:
- Participants must complete all mandatory fields in the online submission form to be considered.
- Only the first submission for a specific location will be eligible for the finder’s fee. Subsequent submissions for the same location will not be considered.
- Evaluation Criteria:
- Submissions must include accurate and complete information (in the Site Finder’s Form in Schedule 1 of these terms and conditions) about the proposed location, including address, property specifications, and local area details.
- The proposed location must be within Lincolnshire Co-op’s current or potential trading areas.
- Lincolnshire Co-op reserves the right to verify the accuracy of the submitted information.
- Finder’s Fee Eligibility:
- The finder’s fee will only be awarded if Lincolnshire Co-op successfully opens a new store at the submitted location.
- The location must be one that Lincolnshire Co-op was not already aware of prior to the submission. Internal records will be checked to confirm this.
- The decision to open a store at any suggested location is at the sole discretion of Lincolnshire Co-op.
- Finder’s Fee Details:
- The finder’s fee is £5,000.
- The finder’s fee will be paid to the person who submitted the location first, as determined by the timestamp of the submission.
- Notification:
- Participants whose submissions are being considered for a new store location will be notified by email.
- If a participant’s suggested location is chosen for a new store, they will be notified once the store opens, and arrangements will be made for the finder’s fee payment.
- Privacy and Data Protection:
- Personal information provided in the submission form will be used solely for the purpose of evaluating suggested locations and will be handled in accordance with Lincolnshire Co-op’s privacy policy and fair processing notice
- Data collected from submissions will be securely stored and processed in compliance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.
- Participants have the right to access, rectify, or request the deletion of their personal data. Requests can be made by contacting dataprotection@lincolnshire.coop.
- General Conditions:
- Lincolnshire Co-op reserves the right to amend these terms and conditions at any time without prior notice.
- By submitting a location, participants agree to be bound by these terms and conditions.
- Confidentiality
- Participants whose submissions are being considered agree that such participants shall not at any time during the participation in this location suggestion campaign and for a period of 5yrs after payment in clause 5 of these terms and conditions, disclose to any person any confidential information concerning the Lincolnshire Co-op’s business, assets, affairs, customers, clients or suppliers of the Lincolnshire Co-op, which such participant may become aware of as a result of participating in the location suggestion campaign.
- The Participants in clause 9(a) agree that in the event of a breach of confidentiality, damages alone would not be adequate remedy and the Lincolnshire Co-op shall be entitled to see remedies of injunctions, specific performance or other equitable relief for any threatened or actual breach of this confidentiality clause.
- Third Party Rights
These terms and conditions are between you and the Lincolnshire Co-op. Apart from the Lincolnshire Co-op and the participant, No one else shall have the right to enforce any part of these terms and conditions.
- Governing Law:
- These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
